Anti CCW businesses

Yesterday I hit a piece of road trash pulling into a fast food place on Havana. When I pulled it from my tire air started rushing out. I was out of options and pulled into the first tire place, the Goodyear Gemini on Havana, just north of Mississippi.

I didn't see the sign right away but did, later on. A small blue and yellow sign with a revolver and the circle with a line through it.

I don't yet have the training but intend to be CCW before the end of 2006. I didn't make a big deal out of the sign but it bothered me. If I had any options I would have taken my business elsewhere but I wasn't packing and the sign was just a sign.

I really, really regret giving that store my money. You can bet I'll be driving on four ruined rims before I ever go back there, though.

Doing business with a store that feels my money is okay but my rights aren't really burns me up.

What I'd like to do is get a listing here of places (Jarred's has been mentioned) that post signs demanding people not to carry. I'd like a list and have the stores involved notified that we are going to boycott.

As bbadmin pointed out RMGO has a list of offending businesses. They also have cards you can print out and hand to them explaining you will take your business elsewhere.

Yes, I guess if the law doesn't specify how businesses can create no CCW zones then they are pretty powerless to enforce. Unless you flash they shouldn't know. It's concealed carry, not open.

It does seem like businesses are trying to set themselves up as above the law, though. What next? Headshops with signs encouraging shoppers to toke up on the premises?

I think you missunderstood what I was trying to point out. I own a business and I can make any "rules" I want but the fact is the "Law" is what matters. They can put up silly signs saying no concealed weapons but that is not a law. They can put up silly signs saying it's ok to smoke crack but that is not the law.

What rules a person makes on their property is not always the law and the law is what counts. If a head shop puts up signs saying toke up anybody that does it can be arrested and charged for violating the law. If they put up signs saying no concealed weapons a person with a valid permit can not be arrested as they are not violating any law.

I personally still avoid any place posted out of principal would rather give my business to somebody else. I am just pointing out that in a situation like you were in and really had no choice I will ignore the sign.

Afterwards I would kindly let them know that I will never come back untill the no gun sign is removed.

(1) (a) A permit to carry a concealed handgun authorizes the permittee to carry a concealed handgun in all areas of the state, except as specifically limited in this section. a permit does not authorize the permittee to use a handgun in a manner that would violate a provision of state law. a local government does not have authority to adopt or enforce an ordinance or resolution that would conflict with any provision of this part 2.

(5) nothing in this part 2 shall be construed to limit, restrict, or prohibit in any manner the existing rights of a private property owner, private tenant, private employer, or private business entity.

The way I read this is that the private owner/tenant DOES in fact have the right to say no CC on their property. Which sucks in my opinion!

In UT, they only have to list it on a web page and not on their building.

You are reading it incorrectly all that portion of the law is saying is this. It is simply acknowledging the fact that the CCW law does not take away a private property owners rights to make their own rules about weapons on their property.

Once again it is their rules it is not a law therefore if I ignore the sign I am NOT breaking any law. All they can do if they discover you are armed is ask you to leave. If you refuse to leave then you can be arrested and charged with tresspassing.

That also goes back to the "how are they going to know you carry" thing.

I noticed on the RMGO sight that a corp is on there. I won't say which because my brother and several friends works there. Funny thing is, my friend carries to work and into work EVERY DAY. Security doesn't seem very worried.

This is an odd issue for me, too. My permit arrived just this past Tuesday, and my holster got here today. I carried for the first time in public today to Flat Irons mall in Broomfield, CO. On the way in I noticed a sign disallowing all firearms, explosives, sticks (yes, I'm serious), and knives with blades longer than 2". :rolleyes

The interesting thing was that the sign was only posted on the enterances that lead from the outside directly into the mall. If one were to enter through Dick's, Eddie Bauer, Nordstrom, etc., no such signs were posted at the enterance to the store from the outside or mall enterance.

But it's good to know that this doesn't matter in CO. I put my gun in the car just to be safe, but now I know I'm good to go!

You're sure that they can't charge you with tresspassing immediately after they realize that you're carrying? It's posted after all. It wouldn't be a good PR move but if you actually had to USE your CCW while on their property then I'm sure the fact that you weren't supposed to have the gun while on their property would come up in court. They couldn't go after you in civil court for all reparations/damages/etc?
