Up until last year I assumed the same thing.
Then I ran across an article that explained how Federal courts have repeatedly ruled that NFA ownership is NOT protected by the US Constitution.
So, I ran that past the (Washington based) attorneys that represent (and are on the board) of FAIR Trade.
The response I received was in agreement with what I read and that this is nothing new, plus they let me know that ATF is very well aware of these court rulings.
It is worth doing a bit of reading on this subject.
